The Security Council agreed to call an extraordinary special session of the 193-member General Assembly on the issue two days after Russia used its veto to thwart a UNSC resolution condemning its actions towards Ukraine.
"Enquiring into the merits of the charges that have been presented on behalf of the All India Trinamool Congress and the intervenor, will cause a further delay in necessary decisions being passed to ensure a free and fair election," the bench led by Justice Chandrachud stated on November 25.
Senior Advocate P S Patwalia, appearing for the appellants, stated that the High Court had previously left it to the SEC to decide whether or not to deploy central forces for the initial phase of polling on February 12.
